Jakarta, July 2023. Our Dr. Eddy M. Leks shared his opinion with Kompas.com titled “According to the rules, can a building block other people’s road access? (Secara Aturan, Bolehkah Bangunan Menutup Akses Jalan Orang Lain?).”
Dr. Leks, explained that legally speaking, closing public access to other parties’ land or property is certainly not permitted. He stated that that action “violates the social function of land which is the spirit and basic principle of the fundamental principals of agrarian law (UUPA).” He furthermore states that “this social function then materializes as an arrangement that the landlords may not block access to other parties who own or possess the land.”
