Provisions of law concerning Management of Household Waste are regulated in Government Regulation Number 81 of 2012. To implement certain articles of that Regulation it is necessary to stipulate a new Regulation by the Minister, called Regulation of the Minister of Public Works 03/PRT/M/2013 (hereinafter referred to as: “Regulation 03/PRT/M/2013“).

The implementation of Infrastructure and Facilities in Waste Handling (hereinafter referred to as: “PSP”) concerns activities on planning, constructing, operating, monitoring and evaluating the handling of Household Waste and Other Type of Household Waste. Household Waste in this context is basically waste originating from household daily activities, excluding feces. Other type of Household Waste among other things concerns waste originating from commercial area and industrial area. In addition to Household Waste, there also is residue. Residue is waste that is non-processable by changing it into solid form, changing it into compost or recycling it into form of material.

Regulation 03/PRT/M/2013 is meant to:

  1. Accomplishing effective implementation of PSP with respecting the environment;
  2. Improving the scope of waste handling service;
  3. Improving the level of community’s health and the quality of the environment;
  4. Protecting water, land and air from pollution and mitigate and temper weather change; and
  5. Putting into words that waste is a resource.

General Planning

For General Planning for PSP amaster plan is required, as well as technical planning and management of waste, and a feasibility study.

The master plan

The preparation of a master plan must follow:

  1. Policy and strategy on PSP implementation;
  2. Norm, standard, procedure, and criteria stipulated by the Government;
  3. Area Space Layout; and
  4. Integrate developments of the supply system of drinking water and the draining system of the city.

The Government is obligated to make an orientation session on the master plan at least once a year.

The feasibility study

The government and/or private party will compose the feasibility study. The study shall be based on:

  1. Master plan of the stipulated PSP implementation;
  2. Technical, economical and financial feasibility; and
  3. Result of environmental, social, law and institutional study.

Technical Planning and Waste Management

Technical Planning and Waste Management shall be composed by Regency/Municipality administration.

Technical Planning and Waste Management contains:

  1. Regional service plan
  2. Service level
  3. Implementation phases; and
  4. PSP implementation plan

Waste Handling

Waste handling covers sorting out, collecting, transport, processing and the final process.

The sorting out of waste must be managed by:

  1. Every person where the waste originates;
  2. Management of residential area, commercial area, or other similar facilities;
  3. Regency/municipality administration element.

The collecting of waste must be managed by:

  1. Management of residential area, commercial area, or other similar facilities; and
  2. Regency/Municipality administration.

The waste transportation shall be exercised by Regency/Municipality administration. Waste processing will take in consideration the characteristics of waste, the environment, occupational safety and the social condition of the community.

Waste final process shall be done using:

–  Method of controlled land-filling;

–  Method of sanitary land-filling; and/or

–  Friendly environmental technology.

The Regency/Municipality is obliged to operate.

Establishment of Waste Processing Facilities and Waste Final Process

The estabslihment of waste processing facilities and final process will be made in phases. First, there is the technical planning, second the construction, then the operation and maintenance, and finally the monitoring and evaluating. On all areas environment and social health must be respected. The Research and Development Agency of the Ministry of Public Works therefore shall investigate and develop application of friendly environmental technology to support implementation of PSP.

The society takes role in making decisions and in implementing PSP. Regency/Municipality may also cooperate with the private sector or a business entity.

The end of the managing process is called Final Processing Place (hereinafter abbreviated into “TPA”). At TPA the waste is processed and restored to the environmental media. Household waste, other household waste, and residue may be discharged to TPA until Year 2025. After 2025 only residue may be discharged into TPA.
